Terms of Use
These terms govern the use of arbitration.org and of the tools it offers ("the Site"), published by International Arbitration Forum Inc., a Delaware non-stock, non-profit corporation with its registered office at 16192 Coastal Highway, Lewes, Delaware 19958, United States ("the Forum", "we"). By using the Site you accept them. If you do not accept them, please do not use the Site.
1. What the Site is
The Site is a free research platform for international arbitration run by a charity. It offers an open database of published arbitral awards, decisions and court judgments; AI-generated case summaries; records of the arbitrators, counsel and experts who appear in those documents; arbitrator profiles; a conflict checker; a research assistant; and news, events and a library of books. We may add, change, suspend or withdraw any part of the Site at any time.
2. Research tools, not legal advice
Everything on the Site is information for research purposes. It is not legal advice, it creates no lawyer–client or other professional relationship, and it is no substitute for reading the source documents and taking advice from a qualified lawyer on your own situation.
The case summaries, the participant records, the arbitrator profiles, the conflict-check results and the answers of the research assistant are produced in whole or in part by artificial intelligence from the published documents. They can contain errors, omissions and wrong matches, for instance between two people of the same name. Every entry links to the page of the document it was drawn from so that you can check it; you must do so before relying on any of it. The database holds only published documents, which are a fraction of all arbitral proceedings; the absence of a case, an appointment or a relationship from the Site is not evidence that it does not exist.
In particular, a conflict-check result is a starting point for your own enquiries and the disclosures required of arbitrators and counsel; it is not a determination that a conflict does or does not exist, and the references to the IBA Guidelines on Conflicts of Interest are indicative only. Arbitrator profiles are not endorsements, rankings or indications of availability, and the Forum does not recommend or certify arbitrators.
3. Accounts
An account is optional and free. You must give a working email address and keep your sign-in method secure; you are responsible for what is done through your account. One person, one account. You must be at least 16. We may suspend or close an account that breaks these terms, and you may delete your account at any time from your account page.
4. Acceptable use
You may use the Site for your own professional, academic or personal research. You may not:
- copy, scrape, crawl or download the database, the profiles, the summaries or any substantial part of the Site by automated means, or compile them into another product, service or dataset, without our written permission;
- resell, sublicense or commercially redistribute content of the Site, or present it as your own;
- circumvent the daily limits, the sign-in, or any other technical measure, or use another person's account;
- use the research assistant or the conflict checker to harass, defame or make decisions about a person unlawfully, or feed them content you have no right to use;
- interfere with the operation or security of the Site, or probe it for vulnerabilities without our permission;
- use the Site for anything unlawful.
Reasonable, non-systematic use of the search and the pages by individuals, including search engines indexing public pages, is of course welcome.
5. Content and intellectual property
Source documents. The awards, decisions and judgments in the database are public records made available by the institutions, courts and parties that published them. We claim no rights in them. Any rights in them belong to their authors or publishers; we make them available for research in the public interest and we remove a document on a justified request.
The Forum's work. The selection and arrangement of the database, the case summaries, the participant records, the profiles, the conflict checker, the research assistant, the texts, the design and the software of the Site are the property of the Forum or its licensors and are protected by copyright and database rights. You may read them, link to them, quote them with attribution to "International Arbitration Forum, arbitration.org", and print or save individual pages for your own research. Any other use needs our written permission.
AI output. You may use the answers of the research assistant in your own work, at your own risk and subject to section 2. We make no claim to copyright in an answer written for you, and we give no warranty that it is free of third-party rights.
Third-party material. News items, event listings and book details are compiled from public sources and link to them; the Site links to other websites that we do not control and for which we are not responsible.
6. People named on the Site; corrections
If you are named in the database or have a profile on the Site, you may ask for a correction, an addition or the removal of profile content by writing to info@arbitration.org. We correct errors promptly. How we handle personal data, and the limits of removal for public court and arbitral records, are explained in the Privacy Notice. Arbitrators may claim their profile; information supplied by an arbitrator is shown as such and remains their responsibility.
If you believe content on the Site infringes your rights, write to info@arbitration.org identifying the page and the right concerned; we will respond promptly.
7. What you send us
Anything you send us for publication (a profile, a correction, a document, an article) you must have the right to send, and you give us a non-exclusive, royalty-free, worldwide licence to publish and use it on the Site and in the Forum's activities, with credit where appropriate. We may decline or remove any contribution.
8. Availability
The Site is provided free of charge and "as is". We aim to keep it available but do not guarantee it, and we may interrupt it for maintenance or for any other reason. The research assistant is subject to daily limits and to a monthly budget, and may be unavailable when those are reached.
9. No warranty and limitation of liability
To the fullest extent permitted by law, the Site and its content are provided without warranty of any kind, express or implied, including as to accuracy, completeness, currency, fitness for a particular purpose and non-infringement. To the same extent, the Forum, its officers, directors, members, volunteers and contributors are not liable for any loss or damage arising from the use of, or reliance on, the Site or its content, including indirect, consequential or special loss, loss of profit, loss of data, or the outcome of any proceeding; and our total liability for any claim is limited to USD 100. Nothing in these terms excludes liability that cannot be excluded by law, including for fraud or for death or personal injury caused by negligence. Consumers in the EU and the UK keep the rights their national law gives them.
10. Indemnity
If you use the Site in breach of these terms and that causes a claim against the Forum, you will compensate the Forum for the resulting loss and reasonable legal costs.
11. Changes
We may change these terms. The current version is always on this page with its effective date; material changes affecting members will be sent to the email address on their account. Continued use after a change means you accept it.
12. Governing law and disputes
These terms and any dispute about them or about the Site are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules, and are subject to the exclusive jurisdiction of the state and federal courts sitting in Delaware. Consumers in the EU or the UK may also rely on the mandatory protections, and bring proceedings in the courts, of the country where they live.
13. General
If part of these terms is held invalid, the rest remains in force. Our not enforcing a term is not a waiver of it. These terms and the Privacy Notice are the whole agreement between you and the Forum about the Site. You may not transfer your rights under them; we may transfer ours to a successor of the Forum's activities.
